Xavier has more than 20 years’ experience in pre‑litigation and litigation of business law cases. He has acquired a specific expertise in commercial and post‑acquisition disputes as well as insolvency and enforcement proceedings.

He is regularly instructed by a number of business players such as owners of construction works, real estate developers and contractors in matters relating to private and public works contracts requiring a specific construction and real estate know‑how, including in the energy sector. He represents a variety of different contractors in construction projects in relation (among other disputes) to court surveys and liability claims. He also provides legal assistance to the negotiation and drafting of contracts relating to property acquisitions and real estate transaction services.

Highlights

Xavier has recently advised :

  • Business companies in relation to a dispute over the implementation of a liability bond (due compliance with the service of a notice letter and price assessment further to the relevant claim) and the resolution of an earn‑out claim (resolution of a dispute relating to the existence of this earn‑out and the assessment thereof)
  • Directors in relation to a liability claim for an alleged breach of care with a particular issue concerning a conflict of interest of the different contractors working on the construction project, the taking‑over of works and Court surveys
  • A joint‑venture of constructors and engineering companies during the negotiation of construction works contracts (drafting of the deed of covenant, technical specifications, amendments, multilateral contracts, subcontracting agreements, guarantees, etc.)
  • A consortium of contractors for the risk management and dispute resolution of technical issues arising during the construction of a private building project
  • A number of contractors and private individuals for the management of insolvency proceedings striking the real estate developers of a sale before completion project
  • Associations and Industrial companies in relation with fight against Cyber crime
